By submitting a device or storage media to OmniDataPlus for evaluation, data recovery, repair, imaging, file transfer, or related services, the customer acknowledges and agrees to the following general terms.
2. Service scope and recovery results
The requested service may include evaluation, diagnosis, stabilization, imaging, file-system reconstruction, board-level repair, clean-bench work, file extraction, file verification, transfer to destination media, or another agreed recovery activity. The exact scope depends on the condition of the device and the work approved by the customer.
A recovery result means that OmniDataPlus was able to retrieve data that is reasonably accessible and capable of being returned to the customer. A successful recovery does not necessarily mean that every requested file, folder, filename, date, database, application, or original directory structure was recovered intact.
Where practical, the customer may be provided with a file listing, sample verification, or other description of the available result before final delivery. The customer is responsible for identifying critical files and reviewing the available recovery result before approval or collection.
3. Diagnosis, quotations, and approval
An initial diagnosis or quotation is based on the device condition and information available at that time. Hidden damage, previous recovery attempts, intermittent failures, encryption, unavailable donor parts, or deterioration during handling may change the required recovery path, cost, timing, or expected result.
No chargeable recovery work beyond an approved scope will be performed without customer approval. If the condition changes materially, OmniDataPlus may pause the case and provide a revised recommendation or quotation.
The customer may cancel before approving chargeable work. After work, expedited service, parts ordering, or another chargeable activity has been approved and begun, completed labour, ordered parts, shipping, and other incurred costs remain payable even if the customer later cancels.
Estimated completion times are estimates only. Delays may occur because of unstable media, parts availability, extensive imaging time, complex reconstruction, customer response time, or circumstances beyond reasonable control.
4. Nature and risks of data recovery
Data recovery often involves devices that are already failing, damaged, degraded, contaminated, encrypted, partially overwritten, or inaccessible. Despite professional handling, a device may worsen, stop responding, or become unrecoverable during diagnosis or recovery attempts.
- Recovery results are not guaranteed, and some files may be incomplete, corrupted, renamed, or unusable.
- Recovered folder structures, filenames, dates, metadata, and application databases may not be preserved.
- Mechanical work may require opening a drive, replacing components, or using donor parts.
- Board-level work may require soldering, component replacement, temporary repair, or device disassembly.
- Recovered devices are not necessarily reliable or suitable for continued use after data extraction.
Unless otherwise agreed in writing, the objective is recovery of accessible data, not restoration of the original device to reliable operating condition.
The customer acknowledges that disassembly, clean-bench work, component replacement, firmware access, or other recovery procedures may void an existing manufacturer, retailer, or third-party warranty. OmniDataPlus does not guarantee that a submitted device can be returned in its original condition.
5. Customer responsibilities
The customer agrees to provide a complete and accurate failure history, including drops, liquid exposure, unusual sounds, power events, previous repair or recovery attempts, passwords, encryption details, and any other information relevant to safe diagnosis.
The customer should identify the most important files and communicate any deadlines before approving work. The customer is responsible for preserving any existing backups and for confirming that returned recovered data is accessible before relying on it or deleting other copies.
Passwords, unlock codes, encryption keys, account credentials, and compatible receiving media may be required. OmniDataPlus is not responsible for delays or inability to complete work caused by missing, incorrect, or unavailable access information.
The customer must disclose swollen batteries, chemical exposure, fire damage, contamination, biological hazards, or any other condition that could make handling or shipping unsafe. OmniDataPlus may refuse, isolate, or arrange appropriate disposal of a hazardous device.
6. Privacy, confidentiality, and data handling
OmniDataPlus will use reasonable safeguards intended to protect submitted devices, customer information, and recovered data from unauthorized access. Access to customer data is limited to what is reasonably necessary to diagnose the case, perform approved services, verify recovery results, and return the data.
The customer acknowledges that limited file names, folder structures, thumbnails, or sample files may need to be viewed to verify whether a recovery is successful. OmniDataPlus will not intentionally disclose customer data except as authorized by the customer, required to provide an approved service, or required by law.
Recovered data and working copies may be securely deleted after the customer has received the result or after the stated retention period communicated for the case. The customer is responsible for promptly collecting, downloading, and verifying recovered data.
OmniDataPlus may suspend work and take any action required by law if submitted devices or recovered data appear to involve unlawful activity, prohibited content, or a credible risk to another person.
7. Fees, donor parts, destination media, and payment
Approved service fees, donor parts, destination media, shipping, taxes, and other agreed costs are payable according to the quotation or invoice. Diagnostic work may be offered without charge, but specialized parts, expedited service, shipping, or approved recovery work may still be chargeable.
Donor parts and consumable components purchased or used for a case may be non-refundable once ordered, installed, altered, or consumed. Unless otherwise agreed, donor parts remain the property of OmniDataPlus after the case.
Destination media supplied by OmniDataPlus is intended for delivery of recovered data. Any manufacturer warranty for that media is separate from the recovery service. The customer should copy recovered data to multiple verified backup locations promptly after receiving it.
Recovered data, destination media, and submitted devices may be held until outstanding approved charges are paid, subject to applicable law.
8. Shipping, storage, and unclaimed devices
The customer is responsible for secure packaging and for the risk of loss or damage while a device is being shipped to OmniDataPlus. Return shipping, courier insurance, and declared value should be selected according to the customer's needs. OmniDataPlus is not responsible for carrier delays, loss, or damage outside its custody.
Customers must collect devices and recovered data within the period communicated for the case. Devices, parts, destination media, or recovered data left unclaimed after repeated contact attempts and a reasonable notice period may be treated as abandoned and securely disposed of, subject to applicable law.
9. Limitation of liability
To the maximum extent permitted by applicable law, OmniDataPlus is not liable for loss of data, loss of use, lost revenue, lost profit, business interruption, loss of opportunity, or indirect, incidental, special, consequential, or punitive damages arising from a device failure, attempted recovery, delay, incomplete recovery, or inability to recover data.
To the maximum extent permitted by applicable law, any direct liability arising from the requested services will not exceed the amount paid to OmniDataPlus for the specific service giving rise to the claim.
Nothing in these terms excludes, restricts, or modifies any right, warranty, condition, remedy, or liability that cannot lawfully be excluded, restricted, or modified.
10. No warranty for recovered or repaired devices
Unless expressly stated in writing, no warranty is provided that a source device, repaired device, temporary repair, recovered operating system, or recovered file set will remain functional after return. Customers should immediately create multiple verified backups of recovered data and should not continue using a failed source device for primary storage.
11. Third-party services and software
When reasonably required and approved, a case may involve destination media, replacement components, software, courier services, or other third-party products and services. Third-party terms and warranties may apply. OmniDataPlus is not responsible for failures or acts of third parties outside its reasonable control.
12. Changes, severability, and governing law
If any part of these terms is found unenforceable, the remaining provisions will continue to apply to the extent permitted by law. These terms are governed by the laws applicable in Ontario, Canada, and the parties agree that disputes will be addressed in the courts having jurisdiction in Ontario, unless applicable law requires otherwise.
Case-specific written quotations, authorizations, or agreements may supplement these general terms. Where a case-specific written agreement conflicts with these terms, the case-specific agreement will govern for that case.
